Dauran e Hajj wafaat paane waale Haaji ke ahkaam

Kabhi kabhaar dauran e Hajj haadsa hone ya yun hi fitri taur par Hajj karne waala achanak wafaat paa jaata hai. Is par us ke warsa bahut ghamgeen hote hain aur us ka Hajj adhoora hone ki wajah se mazeed bechain ho jaate hain. Kisi ka duniya se jaana us ke waariseen ke liye waqa’ee gham ka baa’is hai magar is par rona nahi chaahiye aur jis ki maut Allah ke raaste mein ho aisa shakhs to khushnaseeb hai. Hum sab Allah Taala se dua karen ke ya Rabb hamein neki ki raah mein maut de. Yeh husn e khatma ki alamat (nishaani) hai, Allah ki rehmat se umeed karte huwe aisi maut par Jannat ki raah aasaan ho sakti hai.

Yahan Hajj ke dauran wafaat hone se kayi masail hain jinhein jaanna zaroori hai. Sab se ahem sawal yeh hai ke agar kisi par Hajj farz tha, Allah ki taufeeq se woh Hajj ki adaigi ke liye ghar se nikal pada tha aur Makkah pahunch kar Hajj ki adaigi kar raha tha ke usi dauran us ki wafaat ho gayi to kya us ke warsa par wafaat paane waale ke maal se us Hajj ki qaza wajib hai? Aur us ke ghusl aur kafan ka kya tareeqa hai?

Is ka jawab yeh hai ke jo dauran e Hajj wafaat paa jaaye us ki badi fazeelat hai aise shakhs ki taraf se qaza ka hukm Shari’at mein nahi milta. Allah Taala ne us ki zindagi mein jitna amal karna muqaddar kiya tha utna kar liya aur jitne ki niyyat ki thi us ka mukammal ajr milega. Allah apne bandon par bada meharban hai. Bukhari aur Muslim mein Hazrat Abdullah bin Abbas Radhiallahu Anhuma se riwayat hai unhon ne kaha:
بَيْنَا رَجُلٌ وَاقِفٌ مَعَ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِعَرَفَةَ إِذْ وَقَعَ عَنْ رَاحِلَتِهِ فَوَقَصَتْهُ - أَوْ قَالَ: فَأَقْعَصَتْهُ - فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: اغْسِلُوهُ بِمَاءٍ وَسِدْرٍ، وَكَفِّنُوهُ فِي ثَوْبَيْنِ - أَوْ قَالَ: ثَوْبَيْهِ - وَلَا تُحَنِّطُوهُ، وَلَا تُخَمِّرُوا رَأْسَهُ؛ فَإِنَّ اللَّهَ يَبْعَثُهُ يَوْمَ الْقِيَامَةِ يُلَبِّي​
Tarjumah: Maidaan-e-Arafaat mein ek shakhs Nabi Kareem ﷺ ke saath thehra huwa tha ke apni oontni se gir pada aur us oontni ne us ki gardan tod daali, Nabi Kareem ﷺ ne farmaaya ke paani aur beri ke patton se use ghusl do aur Ehraam hi ke do kapdon ka kafan do lekin khusbhoo na lagaana na us ka sir chupaana kiunki Allah Ta’ala qiyamat mein use Labbaik kehte huwe uthaayega.
(Sahih Bukhari: 1849)

Is Hadees ki roshni mein dauran e Hajj wafaat paane waale ko beri, pani aur ghair khushbu waale sabun se ghusl diya jaayega aur Ehraam ke kapde mein hi kafan diya jaayega. Na us ka baal kaata jaayega, na us ka naakhun kaata jaayega aur na hi use khushbu lagaayi jaayegi. Muhrim ki tarah us ka sir bhi khula rahega aur khule sir, ek chadar, ek izaar mein Namaz e Janazah padh kar dafan kar diya jaayega. Yeh is baat ki alamat (nishaani) hai ke yeh Haaji hai, qiyamat mein woh isi haalat mein Talbiyah pukaarta huwa uthaya jaayega. Haan agar marne waali aurat ho to us ka sir aur chehra samet mukammal badan dhaanpa jaayega. Aur chunki is Hadees mein ya deegar kisi Hadees mein dauran e Hajj wafaat paane waale maiyat ki taraf se qaza ka hukm nahi hai is liye us ki taraf se qaza karna zaroori nahi hai, na use itmam ki zaroorat hai aur na koyi fidya ya kaffara hai. Agar Allah ne maiyat ko maal ki farawani (ziyadti) se nawaza hai aur us ke warasa mein se koyi qaza ke taur par Hajj kar le to is mein koi harj nahi hai bus shart yeh hai ke Hajj qaza karne waala pehle apna Hajj kar chuka ho.

Agar maiyat ne wasiyyat ki thi ke agar main Hajj na kar saka to meri taraf se mere warsa Hajj karen to phir maiyat ke waris par us ki taraf se Hajj karna wajib hai.
Jis ne Hajj ki niyyat ki thi magar Hajj ka Ehraam baandhne se pehle wafaat paa gaya to us ka Hajj baqi hai jise us ka waris ada karega lekin niyyat ka sawab Allah ki taraf se use milega.
Maiyat ke zimme qarz ho aur wasiyyat bhi ki ho to pehle qarz ada kiya jaayega phir wasiyyat poori ki jaayegi.
Isi tarah woh shakhs jise Allah ne Hajj karne ki taaqat di thi magar kisi wajah se woh Hajj na kar saka, na Hajj ki niyyat kar saka aur baghair Hajj ke wafaat paa gaya to maiyat ke tarika (chhode huwe maal) mein se kisi deendar shakhs ko paisa de kar Hajj karaya jaayega chaahe Hajj ki wasiyyat ki ho ya na ki ho.
Agar koyi maiyat taaqat na hone ki wajah se zindagi mein Hajj na kar saka tha to us ki maldaar awlaad faut-shuda walidain ki taraf se Hajj aur Umrah kar sakte hain.
Dauran e Hajj wafaat paane waale ko shaheed kehne ki sareeh daleel nahi milti magar yeh husn e khatma ki alamat hai aur afzal aamaal mein se hai is liye bade ajr o sawaab ki umeed hai jaisa ki Nabi ﷺ ka farmaan upar guzra hai aur ek farmaan yeh bhi hai:
مَنْ خرجَ حاجًّا فماتَ كتب اللهُ لهُ أَجْرَ الحاجِّ إلى يومِ القيامةِ​
Tarjumah: Jo Hajj ke liye nikalta hai aur wafaat paa jaata hai to Allah use qiyamat ke din tak Hajj karne waale ke barabar sawaab dega.
(Sahih ut Targheeb: 1267)

Go ki maiyat ki laash ek mulk se doosre mulk mein muntaqil kar ke dafan ki jaa sakti hai magar yahan mu’aamla aam maiyat ka nahi hai balki Muhrim ka hai jis ka sir khula hota hai aisi maiyat ko doosre mulk mein muntaqil na karna behtar hai. Nabi ﷺ ne shuhada ki lashein muntaqil nahi ki.
Hajiyon mein ek riwaaj aam hai woh apne gharon se kafan le kar chalte hain ke kahien maut aa jaaye to us mein kafan de diya jaaye, aisa karne ki koyi sunnat Rasoolullah ﷺ aur Aap ke ashaab se manqool nahi hai lehaza is amal ko chhod dena chaahiye aur Hajiyon ka kafan to Ehraam ka kapda hai.
Aakhri baat Haajj woh hai jis ne Hajj ka Ehraam bandh liya magar jis ne abhi Ehraam nahi baandha sirf Hajj ka irada ya niyyat ki hai to woh Haajj nahi hai magar Allah Taala niyyat ka bhi poora sawaab deta hai.
