Jab logon se kaha jaata hai ke deen mein nai nai cheezein ijaad na karo, aisa karna bidat hai to kuch log kehte hain ke agar nai nai cheezein nahi ijaad kar sakte to aaj kal ki jo nai nai ijaad hain jaise ki bus, train aur airplane waghera, to yeh jaaiz kaise ho gayin, aakhir ye bhi to nai cheezein hain.

Arz hai ke sirf deen mein nai nai cheezein ijaad karna mana hai na ke dunyawi mamlaat mein, bus, train aur airplane waghera yeh sab dunyawi cheezein hain aur dunyawi cheezon mein asal yeh hai ki hamare liye tamam cheezein jaaiz hain, lekin agar dunyawi cheezon mein se bhi kisi cheez ko khusoosiyat ke saath mana kar diya gaya to woh haram hogi aur aisi soorat mein sirf wahi cheez haram hogi jis ko khusoosiyat se mana kiya gaya ho baqi duniya ki tamam cheezein jaaiz hongi, isi mafhoom ko fuqaha ne is qaide ki shakl mein paish kiya hai:
الاصل فی العبادات الحرمة والاصل فی الاشیاء الحلة
Yani deeni umoor Ibadaat waghera mein asal mein saari cheezein haraam hain sirf wohi karni hain jin ka saboot mile, aur dunyawi umoor mein asal mein tamam cheezein jaaiz hain sirf wohi mana hain jin ki mumani’at ka saboot mile.
Yeh usool aur tafreeq khud ka banaya huwa nahi balki Qurani Aayaat aur Sahih Ahadees se makhooz hai, neeche is silsile ki ek Sahih Hadees paish e khidmat hai:

Imam Ahmad bin Hambal Rahimahullah (Died on 241 hijri) ne kaha:
حَدَّثَنَا عَفَّانُ، قَالَ: حَدَّثَنَا حَمَّادُ بْنُ سَلَمَةَ، قَالَ: أَخْبَرَنَا ثَابِتٌ، عَنْ أَنَسٍ، وَهِشَامِ بْنِ عُرْوَةَ، عَنْ عُرْوَةَ، عَنْ عَائِشَةَ، أَنَّ النَّبِيَّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ سَمِعَ أَصْوَاتًا، فَقَالَ: " مَا هَذِهِ الْأَصْوَاتُ؟ " قَالُوا: النَّخْلُ يُؤَبِّرُونَهُ يَا رَسُولَ اللهِ، فَقَالَ: " لَوْ لَمْ يَفْعَلُوا لَصَلُحَ "، فَلَمْ يُؤَبِّرُوا عَامَئِذٍ، فَصَارَ شِيصًا، فَذَكَرُوا ذَلِكَ لِلنَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، فَقَالَ: إِذَا كَانَ شَيْئًا مِنْ أَمْرِ دُنْيَاكُمْ فَشَأْنَكُمْ بِهِ، وَإِذَا كَانَ شَيْئًا مِنْ أَمْرِ دِينِكُمْ فَإِلَيَّ
Umm ul momineen Aisha aur Sahabi e Rasool Anas Radhiallahu Anhuma se riwayat hai ke ek martaba Allah ke Nabi Sallallahu Alaihi Wasallam ne kuch aawazein suni. Farmaya: Yeh kaisi aawazein hain? Sahaba ne jawab diya: Allah ke Rasool Sallallahu Alaihi Wasallam! Log khajuron ki pewandkaari kar rahe hain. Allah ke Nabi Sallallahu Alaihi Wasallam ne farmaya: Agar yeh log aisa na karen to behtar hai. To us saal logon ne khujoor ki pewandkaari nahi ki, jis ki wajah se us saal khujoor ki fasal achchi na hue, to logon ne is ka tazkirah Allah ke Nabi Sallallahu Alaihi Wasallam se kiya, to Allah ke Nabi Sallallahu Alaihi Wasallam ne farmaya: Jab tumahre duniya ka koi maamla ho to tum usay jis tarah chaaho anjaam do lekin agar tumhare deen ka maamla ho to meri taraf rujoo karo.

Upar zikr ki gai Hadees se maloom huwa ke deeni umoor mein tamam kaam ke karne ki daleel hona yani Allah ke Nabi Sallallahu Alaihi Wasallam se us ka saboot hona zaroori hai, jabki dunyawi maamlaat mein kisi cheez ke na karne ki daleel chahiye yani agar dunyawi umoor mein se kisi cheez se mutalliq mumaniyat warid nahi hai to asal mein woh cheez jaaiz hai, bus, train aur jahaaz waghera aur is jaisi deegar cheezein dunyawi umoor se talluq rakhti hain aur in ki mumaniyat warid nahi hai is liye yeh jaaiz hain.
Jabki Fatiha Khawani, Esaal e Sawab aur is jaise umoor deen se talluq rakhte hain aur Nabi Sallallahu Alaihi Wasallam se in ka suboot nahi is liye yeh jaaiz nahi hain. Is usool ke Quran o Hadees mein aur bhi kai dalail maujood hain, neez yeh usool Ahl e Sunnat ke mustanad (authentic) aimmah ke nazdeek musallam (sabit) hai.

Ek aur mughalta:
Kuch ahl e bidat ne jab yeh dekha ke upar zikr ki gai Hadees aur us se mustambat usool mein to deeni aur dunyawi umoor mein tafreeq ki gayi hai to yeh bokhlahat ke shikaar ho kar aisi misalein talaash karne lage jin se saabit ho ke deen main bhi nai cheezon ki ijaad durust aur bidat e hasana hai.
Chunancha phir in logon ne dawat o tableegh ke wasail for example: Tarjuma, jalse, programme, poster aur deegar tamam tableegh ke zaraye ko misaal ke taur par paish kiya aur kaha ke dekhye yeh umoor to deen se mutalliq hain lehaza deen main nai cheezon ki gunjaish hai.
Arz hai ke yeh tamam cheezein asal mein deen nahi balki un ki haisiyat deen ki tafheem aur deen ki tableegh ke wasail ki hai na ki asal deen ki, aur deen ki tafheem o tableegh mein asal jawaaz hai lehaza us ke liye koi bhi aisa tareeqa ijaad kiya jaa sakta hai jis ki mumani’at kitaab o sunnat mein na ho, for example: Tarjuma, khulasa, istilaahi naam, jalse, programme, poster aur deegar tamam tableegh ke zaraye, yeh saari cheezein asal deen nahi balki deen ki tableegh ke zaraye hain jin ki asal hillat (halal hona) hai lehaza yeh bid’aat nahi.

Mazeed yeh bhi wazeh rahe ke kuch log ilm e fiqh ki istilaahaat ko paish karte hain aur yeh kehte hin‌ ke dekhye farz, sunnat, wajib, mustahab waghera ka riwaj bhi pehle na tha yeh sab baad mein raaij hue aur yeh deen se mutalliq hain is liye deen mein bhi nai cheez ke ijaad ki gunjaish hai.
Arz hai ke ilm e fiqh ki istilaahaat baad ke fuqaha ne ijaad ki hain jin ka maqsood shariyat ke nusoos ki tafheem o tableegh mein aasani paida karna hai, yeh saari istilaahaat ain deen nahi balki deen ki tafheem o tableegh ke wasail hain.

Yahin par yeh bhi wazeh rahe ke kuch log sawal karte rehte hain ke falan cheez farz hai falan cheez sunnat hai is ki daleel Quran o Hadees se dikhao.
Arz hai ke farz o sunnat ki jadeed istilaahat deen ka hissa bilkul nahi hain balki baad ki ijaad hain, is surat mein Quran o Hadees ke nusoos mein is ka mutalba karna siwaye himaqat (bewaqoofi) ke aur kuch bhi nahi hai.
