MAKAN GIRWI RAKHNE KA ADME JAWAZ:

Kisi Se Koi Cheez Khareedne Ya Qarza Lene Par Bataure Zamanath (surety) Koi Cheez Haqdar Ke Paas Rakhne Ko Girwi Kaha Jaata hai, Jab Qeemath Ya Qarz Ada kardunga to Meri cheez mujhe wapas mil jayegi, jayez Maqsad ke liye koi Cheez girwi (rahen) rakhne me koi Kharabi ya qabahath Nahi, Lekin Girwi Rakhi hui Cheez se Fayedah Uthana Na jayez Aur Haram Hai, kyunke qarze ya udhar qeemath ke Badle koi bhi Fayedah Uthana Sood hai, Jaisa ke Abdullah bin Salam Razi Allahu anhu ki Ek riwayat me hai,
Abu burdah Bin abu musa Ash'ari Razi Allahu Anhu Riwayath karte hai,unhone kaha: Mai madina Aaya To Abdullah bin Salam Razi Allahu Anhu Se Meri Mulaqath Hui, unhone (Abu burdah razi Allahu anhu se) Farmaya:
"Tum Aisi SarZameen (iraq) mein rahte ho jahan Sood Ki waba Aam hai, lehaza Agar tera kisi Shakhs ke zimme Koi Haq Hai aur phir wo tumhe Ek tinke Ya jau Ke ek Daane Ya Ek Ghaans ke barabar bhi hadyah (tohfa) De to use Qubool Na karna,Kiyunke Ye SOOD hai."
(Saheeh bukhari:3814)

Is Hadees se wazeh taur par ye Ma'loom hota hai ke qarz ke Badle Koi bhi fayedah uthana Sood hai, Haan girwi rakhi hui cheez par kharch karna Padhta ho to Kharch ke A'oz Thodha Bahut Fayedah Uthaya jasakta hai, Masalan kisi Ne Haqdar ke paas bataure zamanat Koi Janwar waghairah Girwi Rakha ho to use ghaas ya chaarah daal kar us par sawari Ki Jasakti hai ya doodh piya jasakta hai, jaisa ke ek Hadees Mein hai:
Rasoolullah Sallallahu Alaihi wasallam ne Farmaya:
"Sawari Ka janwar agar girwi hai to baqadre Kharch uspar sawari ki jasakti hai aur Agar Doodh Wala janwar girwi hai to kharch ke A'oz uss ka doodh piya jasakta hai, sawar hone wale aur doodh peene wale ke zimme uska kharcha hai."(bukhari:2512)

Hafiz Ibn Hajar Rahimahullah Isski Wazahath Karte hue likhte hai:
"Agar kisi ke paas girwi shudah bakri hai to chaare ki qeemath ke mutabiq usska doodh peene mein koi Harj Nahi, qeemath se zyadah doodh Hasil karna SOOD hai."

Marhoonah Zameen ki surath Me Agar Murtahin (Jis ke paas cheez Rahen Rakhi gayi hai) Theke Par de, to theke ki Raqam Rahin ke qarze se minha kardi jaye.agar murtahin Khud Kaasht kare to paidawar taqseem karke Malik ke hisse ke mutabiq usska qarza kam kardein.

Surath Mas'oolah Mein Kisi Ne qarzah ke badle apna makan girwi Rakha hai, agar qarzdar uss me rihayesh rakhna chahta hai to uss ka kiraya tay kiya jaaye aur uss kiraye ki raqam ko qarze se kam karta rahe, Agar kiraye ki raqam ko qarz se Minha (kam) Nahi karta To Ye sareeh sood hai!

Hamara Rujhan Ye hai ke aisi cheez girwi rakhi jaaye jispar kharch Karne ki zarurath Na padhe jaise zewrath waghairah ta ke wo uss se fayedah Na utha sake, girwi cheez ki haisiyath ek Amanath ki si hai, jab udhar ya qarz chuka diya jaye to Wo Cheez Malik ko asal halath mein wapas kardi jayegi.
